Notification about possible deletion[edit]

Some contents have been listed at Commons:Deletion requests so that the community can discuss whether they should be kept or not. We would appreciate it if you could go to voice your opinion about this at their entry.

If you created these pages, please note that the fact that they have been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with them, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

I have closed Commons:Administrators' noticeboard/User problems#Time for a ban on DRs and speedy deletions? as having a consensus for a three-month ban from speedy deletions and DRs. —‍Mdaniels5757 (talk • contribs) 16:32, 26 February 2023 (UTC)Reply[reply]

License issue with File:1846 Ludvig Verner Helms Daguerreotype.jpg[edit]

Hello, I noticed the subject file I uploaded has been flagged for an incorrect license. I am relatively new at this, and would appreciate any assistance that can be offered. I have read the licensing help pages.

The image is an ancestor of mine (Helms), and the image is in the possession of my family. Helms died in 1918, in England. So, assuming he is the "creator" of the image, it looks like the image should have a public domain license.

However, a copy of the image was published in a book in England "The Borneo Story" in 1956. The image was provided to the author by Helms' family at the time. The image I've used was not copied from the book; it came from the original in our possession. At the time I uploaded, I assumed any existing copyright from the book would not apply to my image since it didn't come from the book. But now I'm not so sure...

Any advice would be appreciated. This seems to be a complicated situation (for me, at least) that crosses international boundaries (I am in US) and can remove the image if that is the safest approach.

Thanks! GuildCV1 (talk) 16:12, 25 March 2023 (UTC)Reply[reply]

@GuildCV1: I don't think that original photographer could be deduced, so {{PD-old-assumed}} is applicable. --EugeneZelenko (talk) 14:17, 26 March 2023 (UTC)Reply[reply]
What about the copy published in the book in London in 1956? GuildCV1 (talk) 15:01, 26 March 2023 (UTC)Reply[reply]
2D reproduction doesn't not create new copyrights. See w:en:Bridgeman Art Library v. Corel Corp.. --EugeneZelenko (talk) 15:36, 26 March 2023 (UTC)Reply[reply]
Thanks for the help! I'll update the copyright on the helms picture. GuildCV1 (talk) 16:34, 31 March 2023 (UTC)Reply[reply]

File:====㽅==== 1.jpg Copyright Problem[edit]

Hello. I am a Wikisource editor. I ported this file because it was an image taken by a South Korean national organization in charge of researching, collecting, compiling, promoting the study of historical materials on Korean history, called the National Institute of Korean History. The image was of a picture on an ancient historical text called the Veritable Records of the Joseon Dynasty. I don't know much about Copyright, but please tell me the appropriate Copyright of such content.

Features:

This file's picture was a portion of a larger picture taken by a South Korean national organization, in South Korea, of a page of a book so old it is undoubtedly in the public domain. What should the Copyright of such image be? Blahhmosh (talk) 03:37, 26 March 2023 (UTC)Reply[reply]

@Blahhmosh: Public domain media should be tagged with proper public domain tag. See Commons:Copyright rules by territory/South Korea. Same applies for other similar files uploaded by you. --EugeneZelenko (talk) 14:28, 26 March 2023 (UTC)Reply[reply]
OK, but how do I change the copyright of a file? Blahhmosh (talk) 16:17, 26 March 2023 (UTC)Reply[reply]
Just click edit tab on file page and replace {{Cc-by-sa-4.0}} with {{PD-South Korea}}. --EugeneZelenko (talk) 15:23, 27 March 2023 (UTC)Reply[reply]

Request[edit]

hi, could you restore these 19th century paintings please?? Thanks :)

Marliorum12 (talk) 16:15, 16 June 2023 (UTC)Reply[reply]

Info: Marliorum12 appears tp be a sockpuppet of LTA A3cb1, who in fact their used several socks for request undeletion of files originally uploaded by them or their other socks. See this CU request. 81.41.175.237 11:57, 17 June 2023 (UTC)Reply[reply]
@Krd: : Sorry, I don't know history of particular user, but files look like reproductions of historical art taken from books. Is there strong reason for not restoring them? --EugeneZelenko (talk) 14:24, 17 June 2023 (UTC)Reply[reply]
All claims made by A3cb1 are completely unreliable, and in many cases the situation was not as it looked like. If you can verify yourself by external sources, beyond being only plausible, that the images are PD, you are welcome to restore them. Krd 15:40, 23 June 2023 (UTC)Reply[reply]

File:Usada Pekora.png[edit]

I cannot understand why this file must be deleted. This picture is the screenshot of a video made by Sakura Miko upload on YouTube. It is licensed CC BY.  See here. The subject of the picture is Usada Pekora who is belongs to Hololive. And Sakura Miko is also belongs to Hololive. Despite they are belongs to same company, Why this picture is copyright violation? 赤座 (talk) 15:31, 3 August 2023 (UTC)Reply[reply]

Best way to sort out all possible copyrights issues (such video release may be not authorized by company) would be to ask company to send permission to Commons:VRT (example: Commons:Email templates. --EugeneZelenko (talk) 15:11, 4 August 2023 (UTC)Reply[reply]
Yeah, I agree it is good way. Asking company to get copyright permission is certainly good way. I think so too. But, in this case, they already say "It can be use by CCBY" on YouTube channel. Despite they already gave permission to us, why I have to send email to them to get permission to use their works? When I upload the files, I certainly attached Template:YouTube CC-BY and links for their videos that licensed CC BY. And I have discussed already such a problem in Commons:Deletion requests/File:Natsuiro Matsuri.png. But you suddenly deleted the pictures and neglect such a things. I know my English skill is very poor, but I cannot help expressing dissent to your opinion.--赤座 (talk) 15:55, 4 August 2023 (UTC)Reply[reply]
Please read Commons:Derivative works. Are you absolutely sure that everybody who place something on Flickr or YouTube under Creative Commons licenses understand that? --EugeneZelenko (talk) 17:22, 4 August 2023 (UTC)Reply[reply]
If we follow your logic, we cannot use all works uploaded on YouTube or Flickr because the creator may not understand about Creative Commons licenses. And in this case, the creator of the video is belongs to the same company of the subject of the picture. Despite they are belongs to same company and they create the video due to their job, why do you think that they does not accept to use their works each other? In addition, I have an evidence to use the work that has been freely licensed for reuse because they indicate so on their YouTube page. I never reuse works without permission. By the way, User:Abzeronow restored File:Sakuramiko2.png because he estimated "Creation of the YouTube channel, which is freely licensed.". It is the part of pictures that you deleted few days ago.--赤座 (talk) 02:38, 5 August 2023 (UTC)Reply[reply]
It's reasonable to do not accept blindly everything what is written on Internet. Same applies to media under Creative Commons licenses uploaded on Commons or other sites. In this particular case it's necessary to find out was particular employee authorized by company to release something or not. --EugeneZelenko (talk) 15:07, 5 August 2023 (UTC)Reply[reply]
